  • In Pennsylvania, a charge of Driving Under the Influence (DUI) has been changed to Driving After Imbibing (DAI).
  • In New Jersey, the term for drunk driving is Driving While Intoxicated (DWI).

Whatever it is called, drunk driving in Pennsylvania and New Jersey has severe consequences - even for a first-time offender. There are mandatory minimum sentences for first-time, second-time, and third-time offenders based on Blood Alcohol Level.

If you are charged with violating any state's DUI, DAI or DWI, law, your driving privileges may be suspended or revoked, your freedom may be in question, you may have to pay substantial fines, increased insurance rates, and your livelihood may be in jeopardy.

At the Hark & Hark law firm, our South Jersey and Pennsylvania DUI lawyers protect your rights immediately after you retain our services. Our first goal is to obtain a dismissal at the Preliminary Hearing by thoroughly cross examining the police officer who claims he saw your drive, drive illegally, or concludes you were drunk. The following factual and legal issues are very important:

  • Was there reasonable suspicion for the police officer to stop you?
  • Was there probable cause to subject you to DUI field sobriety tests?
  • Were the sobriety and breath tests properly administered?
  • Was the breathalyzer machine properly calibrated?
  • Did the officer personally witness you driving poorly?
  • Did you commit any traffic violations?
  • Did you pass the field sobriety test?
  • Were drugs found in your blood?
  • What are the consequences of that?

If the officer or breath machine operator made procedural mistakes in your arrest, we will move to dismiss the charges. We will file pre-trial motions to suppress the illegal car stop, suppress: 1) illegal car stop, 2) illegally taken statements and, 3) faulty blood and breath tests. Regardless of whether we can negotiate ARD, a fair deal for the multiple offender, or try your case, our experienced DUI lawyers will effectively and aggressively fight for your rights.

Drunk driving is a criminal charge.
We take it seriously and so should you.

At Hark & Hark, we represent clients in Pennsylvania and New Jersey. Our criminal defense attorneys try cases in the City of Philadelphia, Chester County, Delaware County, and Montgomery County. We handle cases in each of the county courthouses in Media, West Chester, and Norristown. In New Jersey, we handle cases in every county, especially in Camden County, Burlington County, Gloucester County, Cumberland County, Atlantic County, Cape May County, Huntingdon County, and Ocean County and all of the townships therein. We handle every case from the initial arrest and surrender, through bail proceeding, into preliminary hearings and indictments in New Jersey, to trials and appeal.

If you have been charged with DUI, DAI or DWI for the first time, and have no prior criminal record, you may qualify for a first-time offender Accelerated Rehabilitation Disposition (ARD) program. In Pennsylvania, your eligibility for ARD or pre-trial probation is determined immediately upon your arrest and at your initial court appearance. Having a DUI lawyer to advocate for your rights at that first appearance is crucial to successful legal representation against drunk driving charges.
